Subject: Appeal of a denial of a permit to erect a second floor addition to a compliant Urban House building form resulting in new nonconformities to the existing compliant structure (compliant structures may be altered or enlarged if no existing compliant element of the structure is increased and no new compliant element or nonconformity is created), encroaching 4 1/8 inches into the required 5 foot south side interior setback, in an E-SU-DX zone.

In response to the COVID-19 pandemic we are modifying several of our hearing policies.  Please see the attached information sheet.  This email contains a lot of important info, so please read all the way through.

One of the largest changes is that the BOA will now be conducting hearings fully online/remotely in an effort to promote social distancing and per the guidance of the Denver Department of Public Health and Environment.  All Board Members, City Staff and Appellants will all attend virtually through Zoom. Members of the Public will also be able to attend through Zoom as well.  Members of the public unable tojoin online may come to Webb Building at 201 West Colfax Avenue, Denver, Room 2.H.14, to comment via computer in person.

Another change is that we will now require any documents including exhibits and letters of support or opposition to be submitted no later than 8:00AM on the Monday prior to the Tuesday hearing.  This will allow us to ensure that Board members, City staff, Appellants, and any interested parties will have digital access to all submitted materials.  If you will be submitting additional documents digitally to be reviewed by the Board, please combine multiple files into a single file before emailing it to us.  If you submit multiple documents as individual files, we cannot assure everything will be compiled in the order you intend it to be.

Also, if a Power of Attorney form is required because any legal owner of the property is not able to be present, we still require the original notarized form to be submitted (a scan is not sufficient), so please mail the form to:

You may also drop it off in person.  Although the BOA office is not observing regular hours and staff are largely working from home, you may just leave the POA form in the document dropbox at the BOA counter in the Webb Municipal Building.  If you leave documents in the dropbox, please notify us by email either by replying to this communication or emailing boacontact@denvergov.org

Hearings are conducted remotely by Zoom video.  If you are not familiar or need help to ensure your comfort level with using Zoom Video, please let us know and we will schedule a demo session.

Finally, the Notice of Public Hearing sign will be delivered to the subject property in order to prevent requiring you to come into the office.  The hearing sign is required to be posted for 10 consecutive days prior to the hearing (which will be the Saturday 2 weeks prior to your hearing).  We usually deliver the signs on the Wednesday or Thursday prior to the Saturday posting.
